1. Agreement
These Terms of Service (“Terms”) are a contract between you and FinCHealth for use of the FinCHealth Android application, APIs, and website at https://finchealth.com (collectively, the “Service”).
Our Privacy Policy explains how we handle personal data and is incorporated by reference.
2. The service
FinCHealth helps you organise consented financial and wellbeing signals (for example SMS, payment notifications, optional Gmail bills, and optional Health Connect metrics) into views you can review on your device. Optional cloud features include account sign-in and consented SMS backup.
The Service may be offered in beta or feasibility builds. Features can change, be limited, or be unavailable without notice. We do not promise uninterrupted or error-free operation.
3. Accounts & eligibility
- You must be able to form a binding contract under applicable law.
- If you create an account (for example via Google Sign-In), you must provide accurate information and keep credentials secure.
- You are responsible for activity under your account.
- You must comply with Google’s and Firebase’s terms when using Google Sign-In or Gmail connection.
4. Permissions & consent
You control sensitive access:
- Android permissions (SMS, notifications, Health Connect) are optional for local features that need them.
- SMS backup to our servers requires a separate consent beyond sign-in.
- Gmail connection is optional and uses read-only access you grant.
- You may revoke permissions or consent; some features will stop working as a result.
You represent that you have the right to grant FinCHealth access to the data sources you enable (for example messages on a device you own or control).
5. Acceptable use
You agree not to:
- misuse the Service, probe or disrupt our systems, or bypass security;
- upload unlawful content or content you do not have rights to process;
- use the Service to violate privacy, financial, or communications laws;
- reverse engineer the Service except where mandatory law allows;
- resell or provide the Service as a managed offering without our written permission;
- use automated means to create accounts or scrape the Service in a way that harms operations.
6. Intellectual property
FinCHealth, including software, branding, and site content, is owned by us or our licensors. These Terms do not transfer ownership. You retain rights in content you provide; you grant us a limited licence to host and process that content only as needed to operate features you enable (for example storing consented SMS backups).
7. Disclaimers
FinCHealth is not a bank, lender, insurer, investment adviser, or medical provider. Information shown in the app is for personal organisation and understanding. It may be incomplete or incorrect (for example due to message format changes or parser limits). You should verify important figures with your bank or other primary sources.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
8. Limitation of liability
To the maximum extent permitted by law, FinCHealth and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service.
Our aggregate liability for claims relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the claim, or (b) USD 50, except where liability cannot be limited under applicable law.
9. Suspension & termination
You may stop using the Service at any time and may request deletion of cloud-held data as described in the Privacy Policy. We may suspend or terminate access if you violate these Terms, create risk for other users or the Service, or if we discontinue the product. Provisions that by nature should survive (including disclaimers, liability limits, and IP) will survive termination.
10. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules, unless mandatory consumer protections in your place of residence require otherwise. Courts in Bengaluru, Karnataka, India shall have exclusive jurisdiction for disputes, subject to those mandatory protections.
11. Changes
We may update these Terms. We will update the date above and may provide notice in the app or on the website. Continued use after changes become effective constitutes acceptance, except where applicable law requires a different process.
